Avco v. Turn and Bank Holdings, Inc.

In 2015, AVCO Corporation filed a lawsuit against Turn and Bank Holdings, Inc. in the U.S. District Court for the Middle District of Pennsylvania, holding that AVCO Corporation and AVStar Fuel Systems, Inc. had not infringed on Turn and Bank Holdings, Inc.ā€™s trademarks.Ā  AVCO Corporation v. Turn and Bank Holdings, Inc. and Precision Airmotive, LLC v. AVStar Fuel Systems, Inc. (4:12-cv-01313-MWB) was filed following Turn and Bank Holdingsā€™ allegations that AVCO infringed upon Turn and Bank Holdingsā€™ trademarks for airplane engine fuel injection systems.Ā  In response, Turn and Bank Holdings filed a counterclaim asserting trademark infringement and unfair competition by AVCO and AVStar.Ā  Econ Oneā€™s expert Ms. Krista Holt, who has extensive experience calculating damages for trademark infringement cases, was retained by counsel for AVCO Corporation.Ā 

Ms. Holt was asked to rebut the opposing expert and provided a calculation of damages in the form of disgorged profits from AVCO and AVStar.Ā  Ms. Holt submitted an expert report, provided deposition testimony, and testified at trial.Ā  The Court ruled in favor of Turn and Bank Holdings in March of 2023.Ā  Despite the ruling, the Court relied on Ms. Holtā€™s damages amount.Ā
