Equal Employment Opportunity Commission (EEOC) v. River View Coal

In this class action, the EEOC alleged that the defendant engaged in employment discrimination on the basis of race by denying a class of qualified African American applicants employment for mining positions at River View Coal’s Waverly, Kentucky facility.

Econ One was retained by the EEOC to statistically analyze the hiring of miners at River View’s Waverly location and determine whether African Americans were hired at rates significantly below their representation within various external labor pools. Dr. David Sharp submitted an analysis concluding that African Americans were significantly under-represented relative to their representation, regardless of the various external labor pools examined. The defendant settled the case by signing a consent decree and compensating the class of African American applicants with financial and other relief.
