Gateway, Inc. & Microsoft Corporation Mediation

Computer manufacturer Gateway received an aggregate amount of $150 million (over four years) from Microsoft in a settlement regarding claims arising from Microsoft’s conviction in the case filed against it by the Department of Justice (DOJ) in the mid 1990s. Judge Jackson in the DOJ case had specifically identified Gateway as having its business impacted by Microsoft practices he ruled to be illegal. Econ One was retained by counsel for Gateway to estimate the damages Gateway suffered as a result of Microsoft’s illegal actions. Both Ross Wildes and Jeff Leitzinger presented Econ One’s analyses and results during the mediation and provided responses to the analyses and results of Microsoft’s own damages experts. The successful mediation process was completed prior to Gateway’s filing of a lawsuit against Microsoft.
