James Varga v. Twitch Interactive, Inc.

In February 2018, James Varga filed a lawsuit for breach of contract against Twitch Interactive, Inc. in the Superior Court of the State of California (County of San Francisco).Ā  James Varga v. Twitch Interactive, Inc. a/k/a Twitch.tv, Inc. (CGC-18-564337) was filed following Twitchā€™s suspension of Mr. Vargaā€™s (a content provider for the Twitch platform) Twitch.tv account and termination of his contract.Ā  In response, Twitch filed a cross-complaint alleging breach of contract, breach of implied covenant of good faith and fair dealing, negligent representation, and fraud.Ā  This included claims that Mr. Varga breached his agreement with Twitch by streaming prohibited content and defrauding Twitch and its users in rigged jackpots.Ā  Econ Oneā€™s expert Ms. Krista Holt, who has extensive experience calculating damages for breach of contract cases, was retained by counsel for Twitch.Ā 

Ms. Holt was asked to calculate damages Twitch may have suffered if there was a finding of liability against Mr. Varga.Ā  Ms. Holt submitted an expert report, provided deposition testimony, and testified at trial.Ā  Though the juryĀ  ruled in favor of Varga in April of 2021, the jury agreed with Ms. Holtā€™s damages amount.Ā
