Ashley Nicole Henderson v. The Chemours Company, et al.

In October 2022, a former employee filed suit against defendant The Chemours Company for wrongful dismissal.  The lawsuit, Ashley Nicole Henderson v. The Chemours Company, et al. (2:22-CV-02737), filed in the U.S. District Court for the Western Division of Tennessee, alleged that the plaintiff was unlawfully terminated based on her race.  Such conduct, if proven true, would be in violation of Title VII of the Civil Rights Act of 1964 as well as the Tennessee Human Rights Act.  Dr. D.C. Sharp, an Econ One expert experienced in labor and employment matters, was retained by counsel for the defendant.

Dr. Sharp was asked to evaluate alternative present value damage calculations submitted by the plaintiff’s damages expert.  In his October 2023 report, Dr. Sharp showed that the plaintiff’s damage calculations, among other things, relied upon an improperly long expected worklife, inflated but-for income and benefit streams, and unreasonably low mitigating income and benefit streams.  As a consequence, the plaintiff’s expert’s calculations had inflated the plaintiff’s actual economic losses by 73% to 90%.  Dr. Sharp provided trial testimony regarding his findings on October 29, 2024 and a jury verdict, fully in defendant’s favor, was rendered October 31, 2024.
