For the second time in two years, Managing Director Brian Krieglerās analysis has played a key role in a California Court of Appeals wage & hour case. Plaintiffs were a proposed class of assistant branch managers.Ā The defendant, East West Bank, retained Dr. Kriegler to review and evaluate the sampling and survey methodologies set forth by Plaintiffsā experts. The Court of Appeal relied on Dr. Krieglerās analysis that assistant managers varied in terms of job tasks and managerial responsibilities. The Court of Appeal also concurred with Dr. Krieglerās conclusion thatĀ this variation would likely exist among putative class membersĀ if PlaintiffsāĀ methodologies were applied. Ā As a result, the order denying the class certification motion was affirmed on May 17, 2017.
