Dr. Brian Kiegler plays a key role in California Court of Appeal decision.
For the second time in two years, Managing Director Brian Kriegler’s analysis has played a key role in a California Court of Appeals wage & hour case. Plaintiffs were a proposed class of assistant branch managers. The defendant, East West Bank, retained Dr. Kriegler to review and evaluate the sampling and survey methodologies set forth by Plaintiffs’ experts. The Court of Appeal relied on Dr. Kriegler’s analysis that assistant managers varied in terms of job tasks and managerial responsibilities. The Court of Appeal also concurred with Dr. Kriegler’s conclusion that this variation would likely exist among putative class members if Plaintiffs’ methodologies were applied. As a result, the order denying the class certification motion was affirmed on May 17, 2017.
