Eric Forister to be Honored at 2025 Antitrust Enforcement Awards
We are thrilled to announce that Eric Forister is an honoree at the AAI Antitrust Awards Night 2025 for his work in Innovative Health, LLC v. Biosense Webster, Inc.
Economist Eric Forister of Econ One served as expert witness (liability and damages) for the plaintiff in Innovative Health, LLC v. Biosense Webster, Inc. (a subsidiary of Johnson and Johnson), a Section 2 unilateral conduct case challenging single-brand aftermarket monopolization under a Kodak-style lock-in theory.
Dr. Forister analyzed market definition and market power, evaluated whether Biosense’s conduct amounted to unlawful tying/monopolization scheme, and calculated plaintiff’s damages. In doing so, he developed multiple economic models, authored five expert reports, was deposed twice, and testified twice at trial including on rebuttal, contributing to the post-trebled jury verdict of $442 million in favor of the plaintiff.
Since 2019, Dr. Forister has led the economic analysis in this matter, constructing statistical models to calculate damages, evaluating the economic plausibility of Biosense’s procompetitive justifications, and defending his conclusions at deposition and trial. His commitment extended beyond analytics—he personally visited an electrophysiology lab to deepen his understanding of the technology at issue.
This case addressed monopolistic practices contributing to rising healthcare costs and helped protect hospitals, patients, and downstream competition.
